Judge will not reinstate complaint over the ads of Diet Dr Pepper

SAN FRANCISCO — It's not a weight-loss pledge to call a soft drink "diet," a federal court of appeals ruled Monday.

San Francisco's Ninth U.S. Circuit Court of Appeals declined to re-establish a class-action lawsuit by a woman who argued that Diet Dr. Pepper's makers had committed fraud.
