Advertising lodges a major place in American society. Related to the substratum principles that shaped our nation — free speech, struggle and individual choice — it has served the public since overseas times as a source of energetic information about our open, market-based economy.
Advertising is a helpful force in our free society. There are three core benefits:
• Fuels economic growth. To contest and grow in today’s marketplace, companies must professionally reach clients, alerting them to new product advances and competitive price points.
• Fosters a wide array of inexpensive media choices. Vast, affordable media options enrich our civilization and support a core American value: the democratization of knowledge and information.
• Educate the public. Advertising informs consumers about product choices existing in the marketplace.
Advertising of legal products and services, conducted in a non- deceptive way, has very strong First Amendment Legitimate protection. The U.S. Supreme Court favorably extended that guard to advertising in 1976, in the “Virginia Board of Pharmacy” case. Since then, the Court has supported the First Amendment protections for advertising in a long series of cases. At every level of government — federal, state, and local — advertising is closely scrutinized. The Federal Trade Commission, the government agency with principal specialists over the industry, has the power to ban or control advertising it believes to be false, deceptive, or unfair, as well as to impose penalties on advertisers that violate the law.
Advertising informs consumers about product selections available in the marketplace. Increasingly, it also teaches them about issues that affect their lives. Distinguishing the power of advertising to educate, the industry happily devotes billions of dollars of creative and media resources annually, through The Advertisement Assembly and other public service efforts, for high-visibility campaigns on a variety of disputes.
